What is the generational smoking ban?

The generational smoking ban is a UK law that means anyone born on or after 1 January 2009 can never legally be sold tobacco. It comes from the Tobacco and Vapes Act 2026. Because the age of sale effectively rises by one year every year, it aims to create a smoke-free generation. Sales restrictions start in January 2027.

Smoking remains the UK's biggest preventable cause of death and illness. Most smokers start before age 20. Supporters argue that stopping young people from ever being sold tobacco will save many lives and cut costs to the NHS. People who already smoke legally are not affected. About 12% of UK adults smoked in 2023, according to the ONS, down from nearly 20% a decade earlier.

The Act became law in 2026 after passing through Parliament with cross-party support. It applies across the UK. It also gives powers to restrict vape flavours, packaging, displays and advertising to make them less appealing to children. Enforcement will fall to trading standards officers, who can issue fixed penalties to retailers.

New Zealand passed a similar law in 2022 but repealed it in 2024 after a change of government. That makes the UK the first major country to bring one in. Critics say it is unworkable, will boost the black market and treats adults like children. Shops will need to check ages carefully, with fines for selling to anyone too young. Supporters point to strong public backing in polls.

The view from the left

The left largely backs the ban as a major public health measure that protects young people from addiction.

The view from the right

The right is split: some support it on health grounds, while libertarians see it as nanny state overreach on adult choice.
